Overview

By visiting this website and/or purchasing something from EQUISPORT FITNESS LTD., you engage in the ‘Service’ and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. Those Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. 

Please read these Terms of Services carefully before accessing or using the website http://www.equisportfitness.com/. By accessing or using any part of ‘the Site,’ you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. 

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. EQUISPORT FITNESS LTD. reserves the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to this website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1 - Equisport Fitness is a Web-Based Educational Platform

(a) Equisport Fitness acts as a web-based platform that provides opportunities for users, who comply with Equisport Fitness' policies to access informational and educational materials in a variety of formats (“educational content”), view video lessons, sign up for bootcamp or group coaching sessions, and join an accountability group where you interact with other users (collectively the “Service”).  

 (b) Equisport Fitness does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside Equisport Fitness' control. You use the Equisport Fitness service at your own risk.

(c) Equisport Fitness does not guarantee continuous access to the Service. For example, if at any time, Equisport Fitness terminates, suspends, downgrades, or otherwise limits your Account or access to Equisport Fitness’ services, your ability to access any Program content through the Site may be terminated.  It is your responsibility to maintain and store a copy of your data to ensure future access.

(d) Equisport Fitness makes no representation, warranty or covenant, or guarantee either express or implied, that use of the Site and/or any offered service will result in better health, physical fitness, maintenance of a healthy weight, weight loss, reducing or eliminating nutritional deficiencies, any positive effects on eating disorders, mental well-being, symptom relief, or any particular results or consequences, at all. 

(e) Equisport Fitness does not monitor, pre-approve, or endorse any content created by, or communications between, users in the accountability group. Equisport Fitness has no control over the quality, safety, morality or legality of any aspect of any such user to user communication, or how the information contained in any such communications, used by the users that have access to such communications. Equisport Fitness cannot guarantee the true identity, age, and/or nationality of a use

2 - Online Store Terms

By agreeing to these Terms of Services, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given your consent to allow any of your minor dependents to use this site. 

You may not use the products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 

You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.  

3 - General Conditions

EQUISPORT FITNESS LTD. reserves the right to refuse service to anyone for any reason at any time. 

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

You agree to not reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access the Service or any contact on the website through which the service is provided, without express written permission by EQUISPORT FITNESS LTD. 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 

4 - Accuracy, Completeness and Timeliness of Information

EQUISPORT FITNESS LTD. is not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. 

This site may contain historical information. Historical information, necessarily, is not current and is provided for your reference only. EQUISPORT FITNESS LTD. reserves the right to modify the contents of this site at any time, but EQUISPORT FITNESS LTD. has no obligation to update any information on this site. You agree that it is your responsibility to monitor changes to this site. 

5 - Risks of Use

This website’s content is not a substitute for direct, personal, professional medical care and diagnosis. None of the nutrition or training programs from EQUISPORT FITNESS LTD. should be performed or otherwise used without clearance from your physician or health care provider first. The information contained within is not intended to provide specific physical or mental health advice, or any other advice whatsoever, for any individual or company and should not be relied upon in that regard. Patricia from EQUISPORT FITNESS LTD. is not a medical professional and nothing on this website should be misconstrued to mean otherwise.

There may be risks associated with participating in activities mentioned on EQUISPORT FITNESS LTD. for people in poor health or with pre-existing physical or mental health conditions. Because these risks exist, you will not participate in any nutrition or training program available at EQUISPORT FITNESS LTD. if you are in poor health or have a pre-existing mental or physical condition. If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such dietary activities. These risks may also exist for those who are currently in good health right now.

As with any training program you assume certain risks to your health and safety. Any form of training program can cause injuries, and the training programs offered by EQUISPORT FITNESS LTD. are no exception. It is possible that you may become injured doing the exercises in your program, especially if they are done with poor form. Although thorough instruction is included on form for each exercise, realize that EQUISPORT FITNESS LTD. (like any other exercise program) does involve a risk of injury. If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such exercise activities. These risks may also exist for those who are currently in good health right now.

You are using EQUISPORT FITNESS LTD.’ plans, programs and workouts at your own risk and EQUISPORT FITNESS LTD. is not responsible for any injuries or health problems you may experience or even death as a result of using EQUISPORT FITNESS LTD..

It is to be made clear that EQUISPORT FITNESS LTD. is not responsible for any injuries or health problems you may experience or even death as a result of using any products or services from equisportfitness.com.

You agree that using the products and services of EQUISPORT FITNESS LTD. is at your own risk, you accept the risks for potentially injuring yourself or other negative aspects on your health, and you agree to renounce any (legal) claims against EQUISPORT FITNESS LTD.. 

6 - Generally Expected Results

Although the products and services at EQUISPORT FITNESS LTD. are intended to be fully implemented, sometimes they are not, which could result in a lack of progress/results for the user. If you implement the products and services from EQUISPORT FITNESS LTD. correctly you should see amazing results, however it must be disclaimed that even when consumers implement any products or services in full from EQUISPORT FITNESS LTD. it is still possible they will not get the results they may have expected and it is also possible they will not lose fat or gain muscle or achieve any positive results of any kind.

7 - Testimonial Disclaimer

All the transformations and testimonials are real. However, it must be disclaimed that these testimonials are not claimed to represent typical results with EQUISPORT FITNESS LTD.’ programs, they are meant as a showcase of what the most motivated and dedicated people can achieve by following the personalized nutrition and training programs. Your results may vary from using EQUISPORT FITNESS LTD., and you may not get the same results compared to someone else when using the services due to differences in your individual exercise history, genetics, and personal motivation/dedication. The end results you get will depend upon the individual and how much effort you put in.

8 - Modifications to Service and Prices

Prices for the products are subject to change without notice.

EQUISPORT FITNESS LTD. reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. 

EQUISPORT FITNESS LTD. shall not be liable to you or to any other third-party for any modification, price change, suspension or discontinuance of the Service.  

9 - Services

EQUISPORT FITNESS LTD. reserves the right, but is not obligated, to limit the sales of Services to any person, geographic region or jurisdiction. EQUISPORT FITNESS LTD. may exercise this right on a case-by-case basis. EQUISPORT FITNESS LTD. reserve the right to limit quantities of any Services that are offered. All descriptions of services or service pricing are subject to change at anytime without notice, at the sole discretion of EQUISPORT FITNESS LTD.. EQUISPORT FITNESS LTD. reserves the right to discontinue any service at any time. Any offer for any service made on this site is void where prohibited. 

EQUISPORT FITNESS LTD. does not warrant the quality of any services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

10 - Membership and E-books

(a) Equisport Fitness provides a paid monthly membership subscription service (the "Membership(s)") to you subject to the Terms contained in this Agreement and the Privacy Policy. If you elect to access any paid component of the Site, such as becoming a subscriber of a paid Membership, you agree to pay all fees and charges associated with that paid component on a timely basis. You may purchase subscription access to a Membership (a "Subscription") for a fee (the "Fee(s)") for a thirty (30) day period (“Access Period”). Unless otherwise stated, all Fees are due and payable in advance, are non-refundable, and are exclusive of any applicable federal, state, telecommunications, excise, municipal taxes or duties, including HST and GST, or other local taxes (“Applicable Taxes”). All such Fees will be charged to the payment method you provided when you elected to access that paid component of the Site. You agree to maintain a valid, accurate, and up to date payment method during the term of your use of such services.

The costs of programs and services are in Canadian Dollars (CAD).

Since we have a clear and explicit Refund Policy that you have agreed to prior to completing a purchase through EQUISPORT FITNESS LTD, we do not tolerate or accept any type of chargeback or dispute threat or actual chargeback from your credit card company or payment processor. If a chargeback is placed on a purchase or we receive a chargeback threat during or after your purchase, we reserve the right to report the incident to all three credit reporting agencies or to any other entity for inclusion in any chargeback database or for listing as a delinquent account, which could have a negative impact on your credit report score. The information reported will include your name, email address, order date, order amount, and billing address. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.

(b) Your ability to access and use your Membership commences on the date Equisport Fitness makes the Membership available to you following your registration for such Membership and remittance of the Fee and Applicable Taxes, if any, and continues for the duration of the Access Period. Equisport Fitness will automatically renew your Subscription for additional thirty day Access Periods by charging the associated Fee plus any Applicable Taxes to the payment method you provided unless you cancel your Subscription as provided below. 

(c) Unless you affirmatively opt-out of automatic renewal before the end of the then-current Access Period (as applicable), you hereby authorize Equisport Fitness to renew or commence your Subscription automatically at the end of each Access Period for a new Access Period. If you opt-out of automatic renewal, your Subscription will expire and your access to your Membership will cease at the end of the then current Access Period. In order to continue to access your Membership after your Access Period has expired, you will need to purchase a new Subscription. Equisport Fitness assumes no responsibility or liability if your Subscription fails to renew or otherwise expires because of outdated or incorrect payment information.

 (d) You may cancel your Membership Subscription at any time by emailing Equisport Fitness at equisportfitness@gmail.com. If you cancel your Subscription during your current Access Period, your access to the Subscription will continue until the end of your then-current Access Period, at which point it will expire. Purchase and/or redemption of your Subscription is final and non-refundable; Equisport Fitness will not issue you any refund, including partial, pro-rated, or otherwise unless required to do so by law.

(e) Equisport Fitness also allows you to join or register for group coaching sessions through the Site. Any sessions requiring payment in advance will be billed to the payment method associated with your account upon registration.  Coaching sessions take place on Zoom, which is an online video conferencing platform (and we reserve the right to change platforms at any time at our discretion). You understand and acknowledge that Equisport Fitness does not have control over these platforms or their security. Please review their terms and conditions and privacy policies prior to using them. 

(f) Equisport Fitness reserves the right to modify, offer additional, or cease offering its Membership(s) at any time in its sole discretion, including but not limited to changes in Fees, or modifying the features and functionality of the Site and any Membership Subscription. If we cease offering your current Membership, your access to your Membership will continue until the end of your then-current Access Period. We will provide you with thirty (30) days prior notice via email before changes in Subscriptions or Fees take effect. Any changes to the Subscription or Fees will be effective upon your next billing cycle, and will not apply retroactively or to the remainder of your current Access Period. 

(g) eBooks such as recipe and fitness eBooks and videos are electronic products, and therefore cannot be “returned”. They are non-refundable.

11 - Intellectual Property

 (a) The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Equisport Fitness, our licensors, or other providers of such material and are protected by Canada and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

  • You may store files that are automatically cached by your Web browser for display enhancement purposes.

  • You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

  • If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

  • If we provide social media features with certain content, you may take such actions as are enabled by such features.

You must not:

  • Modify copies of any materials from this Site.

  • Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.

  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this Site.

You must not access or use for any commercial purposes any part of the Site or any services or materials available through the Site.

If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Site in breach of the Terms, your right to use the Site will stop immediately and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the Site or any content on the Site is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of the Site not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

(b) Equisport Fitness, and other Equisport Fitness graphics, logos, designs, page headers, button icons, scripts, and service names are copyrights, registered trademarks, trademarks or trade dress of Equisport Fitness Ltd. in the Canada and/or other countries. Equisport Fitness’ trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion to consumers or in any manner that disparages or discredits Equisport Fitness.  All other trademarks not owned by Equisport Fitness that appear on this site are the property of their respective owners.  

(c) You acknowledge and agree that any content, including but not limited to text, data, photos, graphics, etc. or other material contained or distributed on or through the Site, by Equisport Fitness, its advertisers or other third parties, is protected by trademarks, service marks, patents, copyrights, or other proprietary rights and laws. You may not use or distribute any content received through the Site without the authorization of Equisport Fitness or the content owner. You agree not to publish, reproduce, copy, in whole or in part, nor upload, download, post, email, sell, or otherwise distribute content available through the Site, in violation of applicable copyright and other intellectual property laws.

(d) You acknowledge and agree that the Site and any software provided to you or used in connection with the Site, including, for example and without limitation, any Equisport Fitness API, Widget integration, or other scripts ("Software") contains proprietary and confidential information that is protected by applicable intellectual property and other laws.  Other than as expressly provided under these terms, you agree not to reproduce, duplicate, copy, sell, resell or exploit for other commercial purposes, any portion of the Site, without Equisport Fitness’ express written consent.

(e) Equisport Fitness may make certain software available to you through the Site. If you download software from the Site, the software, including all files and images contained in or generated by the software, and accompanying data (collectively, “Software”) are deemed to be licensed to you by Equisport Fitness for your personal, noncommercial, home use only. Equisport Fitness does not transfer either the title or the intellectual property rights to the Software, and Equisport Fitness retains full and complete title or license to the Software as well as all intellectual property rights therein, as applicable. You may not sell, redistribute, or reproduce the Software, nor may you decompile, reverse-engineer, disassemble, or otherwise convert the Software to a human-perceivable form.

12 - Accuracy of Billing and Account Information

EQUISPORT FITNESS LTD. reserves the right to refuse any order you places with EQUISPORT FITNESS LTD.. EQUISPORT FITNESS LTD. may, in sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that EQUISPORT FITNESS LTD. makes a change to or cancel an order, EQUISPORT FITNESS LTD. may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. EQUISPORT FITNESS LTD. reserves the right to limit or prohibit orders that, in sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at the shop. You agree to promptly update your information, including your email address and credit card numbers and expiration dates, so that transactions can be completed and EQUISPORT FITNESS LTD. can contact you as needed.

13 - Optional Tools

EQUISPORT FITNESS LTD. may provide you with access to third-party tools over which EQUISPORT FITNESS LTD. neither monitor nor have any control nor input. 

You acknowledge and agree that EQUISPORT FITNESS LTD. provide access to such tools ‘as is’ and ‘as available’ without any warranties, representations or conditions of any kind and without any endorsement. EQUISPORT FITNESS LTD. shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). 

EQUISPORT FITNESS LTD. may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Services.

Certain content and services available via our Service may include materials from third-parties.

EQUISPORT FITNESS LTD. is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. 

15 - User Comments, Feedback and Other Submissions

If, at the request of EQUISPORT FITNESS LTD., you send certain specific submissions or without a request of EQUISPORT FITNESS LTD., you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that EQUISPORT FITNESS LTD. may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comment that you forward to EQUISPORT FITNESS LTD.. EQUISPORT FITNESS LTD. is and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. 

EQUISPORT FITNESS LTD. may, but has no obligation to, monitor, edit or remove content that EQUISPORT FITNESS LTD. determines in sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

17 - Errors, Inaccuracies, and Omissions

Occasionally there may be information on this site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers and availability. EQUISPORT FITNESS LTD. reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). 

EQUISPORT FITNESS LTD. undertakes no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

19 - Disclaimer of Warranties; Limitations of Liability

EQUISPORT FITNESS LTD. does not guarantee, represent or warrant that your use of the service will be uninterrupted, timely, secure or error-free.

EQUISPORT FITNESS LTD. does not warrant that the results that may be obtained from the use of the service will be accurate or reliable. 

You agree that from time to time EQUISPORT FITNESS LTD. may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by EQUISPORT FITNESS LTD.) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either expressed or implied. 

In no case shall EQUISPORT FITNESS LTD., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service, including, but not limited to, any errors or omissions in any content, or any loss or damage any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. 

20 - Indemnification

You agree to indemnify, defend and hold harmless EQUISPORT FITNESS LTD. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to arising our of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party. 

21 - Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provisions shall nonetheless be enforceable to fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. 

22 - Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

These Terms of Service are effective unless and until terminated by either you or EQUISPORT FITNESS LTD.. You may terminate these Terms of Service at any time by notifying EQUISPORT FITNESS LTD. that you no longer wish to use EQUISPORT FITNESS LTD.’ Services, or when you cease using our site.

If in EQUISPORT FITNESS LTD.’ sole judgment you fail, or it is suspected that you have failed, to comply with any term or provision of these Terms of Service, EQUISPORT FITNESS LTD. may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to the Services (or any part thereof).

23 - Subpoena Fees

If Equisport Fitness has to provide any information concerning you, your account, and/or your use of the Site or services, in response to a subpoena, court order, or other legal, governmental, or regulatory inquiry related to your account, then we may charge you for our costs.  These fees may include legal fees, and labor fees, for the time our employees spend retrieving such information and records, preparing documents, and/or participating in any depositions or discovery proceeding. 

24 - Entire Agreement

The failure of EQUISPORT FITNESS LTD. to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by EQUISPORT FITNESS LTD. on this site or in respect to The Service constitutes the entire agreement and understanding between you and EQUISPORT FITNESS LTD. and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and EQUISPORT FITNESS LTD. (including, but not limited to, any prior version of the Terms of Service). 

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
